What is DPIIT recognition, and who is eligible for it?

Quick Answer

DPIIT (Department for Promotion of Industry and Internal Trade) recognition is a certification granted to eligible entities under the Startup India initiative, unlocking benefits like income tax exemption under Section 80-IAC, Angel Tax exemption, self-certification for labour and environmental laws, and easier public procurement access. Eligibility requires the entity to be a private limited company, LLP, or registered partnership firm, incorporated within the last 10 years, with turnover not exceeding Rs 100 crore in any financial year since incorporation, and working towards innovation or scalable business models — not formed by splitting up an existing business.

What DPIIT recognition actually is

DPIIT recognition (commonly called 'Startup India recognition' or getting a 'Startup India certificate') is a formal status granted by the Department for Promotion of Industry and Internal Trade, part of the Ministry of Commerce and Industry. It is distinct from company incorporation itself — a company can be validly incorporated and operating for years without ever applying for or receiving DPIIT recognition.

Entity type eligibility

Only a Private Limited Company, a Limited Liability Partnership, or a registered Partnership Firm can apply. Sole proprietorships and unregistered entities are not eligible — this is one of the more common early-stage mismatches, since many founders start as informal proprietorships before realising DPIIT recognition requires a more formal structure.

The 10-year age limit

The entity must not have completed more than 10 years from its date of incorporation or registration at the time of applying. Once a company crosses this age, it becomes permanently ineligible for fresh DPIIT recognition, regardless of how innovative or early-stage its business genuinely still is.

The Rs 100 crore turnover cap

Annual turnover must not have exceeded Rs 100 crore in any financial year since incorporation. This is a cumulative condition — even a single year crossing the threshold disqualifies the entity from applying or continuing to hold recognition going forward.

The innovation and scalability requirement

The entity must be working towards innovation, development, or improvement of products, processes, or services, or have a scalable business model with high potential for employment generation or wealth creation. It must not have been formed by splitting up or reconstructing an already existing business — a rule specifically aimed at preventing established businesses from re-registering as a 'startup' purely to access the tax and compliance benefits.

Frequently Asked Question

Can a sole proprietorship apply for DPIIT recognition under Startup India?

No. Only a Private Limited Company, Limited Liability Partnership, or registered Partnership Firm is eligible to apply for DPIIT recognition — sole proprietorships and informal or unregistered business structures do not qualify. A founder operating as a sole proprietor who wants Startup India benefits needs to first incorporate as one of the eligible entity types.
