How the GST late fee is calculated
For a normal return with tax liability (like GSTR-3B or GSTR-1), the late fee is ₹50 per day of delay, capped at a maximum of ₹10,000 per return. This ₹50 splits equally into ₹25 CGST and ₹25 SGST for every day late.
For a nil return — where you have no sales, purchases, or tax liability to report for the period — the late fee is lower at ₹20 per day, capped at ₹500 per return. This splits into ₹10 CGST and ₹10 SGST per day.
Once the cap is hit, the fee stops increasing regardless of how many additional days pass. But there's no ceiling on how long the fee applies before the cap — it accrues daily from the due date until you actually file.
Late fee structure at a glance
| Return type | Rate | Maximum (cap) | CGST + SGST split |
|---|---|---|---|
| Normal return with tax liability | ₹50/day | ₹10,000 | ₹25 + ₹25 per day |
| Nil return | ₹20/day | ₹500 | ₹10 + ₹10 per day |
The late fee period is counted from the day after the due date to the actual date of filing. Interest on any unpaid tax liability is separate from this late fee and is not included in this calculation.

Get Help Filing →Is there a late fee for a nil GST return?
Yes. Even a nil GST return attracts a late fee — ₹20 per day (₹10 CGST + ₹10 SGST), capped at ₹500. Many taxpayers assume that if there's no tax liability, there's no penalty for filing late — that's not the case under GST law.
What's the maximum GST late fee?
The late fee is capped at ₹10,000 per return for normal returns with tax liability (₹50/day) and at ₹500 for nil returns (₹20/day). Once the cap is reached, the late fee doesn't increase further no matter how many more days pass.
Can I pay the GST late fee using input tax credit?
No. The GST late fee must be paid in cash through the electronic cash ledger — it cannot be settled using your input tax credit (ITC) balance.
How is the late fee period counted?
The late fee is counted from the day after the due date of the return until the actual date of filing. Every day in that window, including weekends and holidays, counts toward the total.
